Washington Law – Government Negligence
Washington State allows victims to sue government agencies for negligence. Victims and their families can sue for such violations as:
- Failure of the DEL (Department of Early Learning) to license, monitor and inspect day care centers.
- Failure of the DSHS (Department of Social and Health Services) to license and monitor foster homes and foster parents.
- Failure to supervise parolees who come into contact with children.
- Sexual abuse perpetrated in schools by students, teachers or other employees.
- Injuries that occur on government property, including universities, hospitals, office buildings and parks.
Injuries that take place in day care or foster care establishments are often the result of incidents that could have and should have been prevented. Most daycare injuries are caused by daycare negligence, such as:
- Failure to adequately monitor children – a caregiver should be able to see each child at all times. Children can get into trouble in seconds when adults aren’t paying close attention.
- Failure to repair or maintain equipment, such as playground apparatus, causing accidental injury.
- Failure to secure cleaning chemicals.
- Failure to secure the premises so that children cannot run away or strangers cannot enter.
Daycare abuse can also occur when daycare centers fail to screen their employees, allowing people with a history of child abuse or other criminal behavior to care for children.
